Unilin files patent infringement suit against Windmöller

On 12 September, the Unilin Group filed a patent infringement suit against Windmöller GmbH at the Düsseldorf Regional Court. At the same time, Unilin demanded an injunction prohibiting Windmöller from producing and selling the disputed floor coverings. According to Unilin, Windmöller infringes the European patent EP 2 588 311 granted to Unilin on May 3, 2017, which refers to elastic floor coverings with a back reinforcement such as glass fleece.

At the beginning of February 2018, Windmöller filed an opposition against this patent in the course of disputes between Unilin and Windmöller Consulting GmbH over the continuation of the existing licensing cooperation between the two companies for plastic-based floorings, which had been ongoing since January. However, Unilin assumes that this opposition will be rejected by the European Patent Office and that the patent will thus be confirmed.

According to Unilin, the patent infringement proceedings now filed are expected to result in a first instance decision within the next twelve months.
